BYD Responds to Inclusion in US Department of Defense Chinese Military Companies List

Gasgoo Munich-Gasgoo has learned that on June 8, 2026, the US Department of Defense updated its “Chinese Military Companies” list under Section 1260H of the National Defense Authorization Act. In response, BYD stated in a filing to the Hong Kong Stock Exchange the same day that it is neither a Chinese military company nor a military-civil fusion enterprise, arguing that its inclusion lacks justification. The automaker emphasized that the list is not a sanctions list and does not impact normal business operations or dealings with parties other than the US Department of Defense. BYD added that related procurement restrictions will not affect its business, and the designation does not restrict securities trading.

Joining BYD, NIO also released a filing with the Hong Kong Stock Exchange, stating that its inclusion lacks merit as it is neither a Chinese military company nor a military-civil fusion contributor to the defense industrial base. NIO noted that the list is not a sanctions list, and US government procurement restrictions associated with it will not impact its business or restrict securities trading. The company said it will actively communicate with the US Department of Defense and take legal action if necessary to safeguard the interests of the company and its shareholders.

Both automakers underscored the limited impact of the list in their announcements and said they will continue to monitor developments and take appropriate measures.
